Misdemeanor Expungement Without Probation

You must fulfill ALL of the following conditions*:
  1. One year has passed since sentencing;
  2. Complied with all terms of sentence (paid fines, attending classes, etc.);
  3. Not currently serving a sentence for a different offense;
  4. Not currently charged with a crime;
  5. Lived an honest and upright life since sentencing and obeyed the laws of the land; and
  6. Paid any court-ordered restitution.

Misdemeanor Expungement With Probation

You must fulfill ALL of the following conditions*:
  1. Fulfilled the conditions of probation for the entire probation period OR probation was successfully terminated early;
  2. Not currently serving a sentence for a different offense;
  3. Not currently charged with a crime; and
  4. Paid any court-ordered restitution.

Expungement In the Interests of Justice

If you do not meet the requirements above, you may still ask the court to expunge your case. However, you will need to file a written statement explaining why expungement is “in the interest of justice” (see Penal Code section 1203.4(a)(1).)
